1. Identity and address of the Data Controller
Retry Pay, S.A.P.I. de C.V., located at Avenida Hidalgo 1995, Int. 7-09, Colonia Ladrón de Guevara, Z.C. 44600, Guadalajara, Jalisco, Mexico, hereinafter the Controller of personal data processing, informs you as follows regarding the handling of personal information collected from you as the Data Subject.
This Privacy Notice is grounded on Article 16 section II of the Political Constitution of the United Mexican States and on the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), articles 3, 8, 15, 16, 25, 28, 36, 37, its Regulations and Guidelines.
2. Personal data collected
Personal data is any information concerning an identified or identifiable natural person. The personal data we collect, for which accuracy you as the Data Subject are responsible, include:
- Full name.
- Valid official ID.
- Email address.
- Tax ID (RFC).
- Fiscal address.
- Contact phone number.
- Bank details for collection or deposit via interbank transfer, where applicable.
For legal entities, we collect: corporate name, incorporation details, documents accrediting personality and legal powers of the representative, official ID of representative or attorney-in-fact, address for notifications, email, RFC, bank details, and proof of tax status.
3. Sensitive personal data
Sensitive data are those personal data that affect the most intimate sphere of the Data Subject, or whose improper use may result in discrimination or pose a serious risk. Retry Pay will not request sensitive data from you.
4. Collection of personal data
Retry Pay will collect personal data, and data of the legal entity where applicable, through your representative at the time of contracting, or by requesting partial data at the time of requesting services through our website, and completing the collection at the moment of contracting.
5. Purpose of processing
Personal data will be used to formally establish the contractual relationship between the Data Subject and Retry Pay.
6. Transfer of personal data
The data collected in the service order will be transferred exclusively to Auditors, Tax advisors and/or Payment Processors or similar, with whom Retry Pay has a contractual or business relationship and has executed a confidentiality agreement, in order to carry out internal control procedures. By accepting this Notice, you authorize such transfers.
If your data is requested by any authority, we will notify you so you can exercise your rights. In no case will the data provided be used for discriminatory purposes.
7. ARCO Rights
Under the LFPDPPP, you have the rights of Access, Rectification, Cancellation, and Opposition (ARCO) regarding your personal data.
- Access: to know which personal data we hold and the conditions of its processing.
- Rectification: to rectify inaccurate or incomplete data.
- Cancellation: to request the cancellation of your data when it is not being processed in accordance with the LFPDPPP.
- Opposition: to object to the processing of your personal data when legitimate cause exists.
You may exercise these rights at any time by email to legal@retrypay.com or by signed written request sent to the Controller's address.
Regarding cancellation, opposition, or revocation, Retry Pay may be unable to carry out the contractual relationship with you, without liability. Requests will be evaluated under the LFPDPPP, its Regulations, and Guidelines.
8. Security measures
The Controller has implemented technical and organizational security measures that prevent the use of your data for purposes other than those authorized in this Notice, as well as its alteration, loss, theft, or access by unauthorized persons.
9. Authorization and amendments
If the Data Subject does not authorize this Privacy Notice, Retry Pay will be unable to render any service. This Notice may be modified at any time, with the current version published on retrypay.com.
